1.1. The Ecosystem: This Agreement governs the access and use of the website www.discover-corfu.com, the mobile application “Discover Corfu”, and all associated digital interfaces, tools, and functionalities (collectively, the “Platform”).
1.2. The Operator: The Platform is owned and operated by Konstantinos Doukas, a sole proprietorship registered in Greece.
1.3. Professional Status: The Company is a travel agency licensed by the Greek National Tourism Organisation (GNTO/EOT). While we hold professional credentials, the Platform primarily functions as a Digital Facilitator, Information Society Service, and Proprietary Multi-Vendor Intermediary.
1.4. No Package Travel: Unless a bespoke, written “Package Travel Contract” is executed and signed by both parties, use of this Platform does not constitute a “Package Holiday” or “Package Tour” as defined under EU Directive 2015/2302. Our role is strictly limited to that of a digital technology intermediary and information provider.
1.5. Acceptance: By accessing, downloading, registering an account, or interacting with Vendors on the Platform, the User (“You”) enters into a binding legal contract. If you do not agree, you must immediately cease use and uninstall the Application.
2.1. Service Availability: The Platform is provided on an “As Is” and “As Available” basis. We do not guarantee that the Platform will be uninterrupted, error-free, or completely secure. We accept zero liability for any disruption in service, technical glitches, app crashes, or loss of access that may result in missed bookings, communication delays, or financial loss.
3.1. Directory Integrity: The Platform hosts a filterable directory for local businesses. The Company does not independently verify, and does not warrant, that a listed business is open, safe, or provides the quality of service described in their profile.
3.2. Direct Contractual Privity: When you send a booking request or inquiry via our Platform, you are communicating directly with the independent third-party Vendor. Every subsequent transaction or agreement creates a direct legal contract exclusively between the User and the Vendor.
3.3. Zero Liability for Transactions: Discover Corfu takes no commission on your booking and processes no User payments for Vendor services. We hold zero vicarious liability for the Vendor’s performance, safety, legality, cancellations, or refund policies. Any dispute regarding a service, payment, or refund is strictly between the User and the respective business.
4.1. Vendor Governance: All cancellations, refund requests, or changes to a booking are governed strictly by the individual terms and cancellation policies of the specific Vendor.
4.2. No Platform Intervention: Discover Corfu does not hold, process, or manage payments between Users and Vendors. Consequently, the Company has no legal authority or technical ability to issue refunds, reverse payments, or intervene in payment disputes.
4.3. Dispute Resolution: Any disagreement regarding the quality of service or a request for a refund must be settled directly between the User and the Vendor.
5.1. Greek Climate Resilience Tax: Under Law L. 5073/2023, a Climate Resilience Tax applies to all accommodations in Greece. This tax is typically payable directly to the accommodation owner upon arrival, unless otherwise arranged or specified by the accommodation provider. The Accommodation Owner is solely and exclusively responsible for the calculation, collection, and remittance of this tax.
6.1. Data Usage: Users are solely responsible for all mobile data costs incurred while using the App or Website.
6.2. Albanian Roaming Risk: Due to Corfu’s geographic proximity to Albania, mobile devices may inadvertently connect to non-EU networks. This can result in extraordinarily high roaming charges.
6.3. Full Waiver: The Company assumes zero liability for any telecommunications fees, data overages, or roaming charges. Users are advised to manage network selection settings manually.
7.1. Weather & Climate: Weather conditions on Corfu can change rapidly and unexpectedly. The Company accepts zero responsibility or liability for cancellations, losses, property damage, personal injury, or death resulting from weather events, climate conditions, or natural phenomena affecting any travel, transport, or activity mentioned on the Platform.
7.2. Guides & Narrative Content: All descriptions of villages, beaches, hiking trails, attractions, and “hidden gems” across the Website and App are for informational/narrative purposes only. Exploration of Corfu is at the User’s sole and absolute risk. The Company is not liable for accidents, injuries, or fatalities occurring at any location or route described in our guides.
7.3. Transport Data: Information regarding bus routes, ferry timetables, and local events is sourced from public third-party data. We do not warrant accuracy and are not liable for missed transport or financial losses.
8.1. AI Assistant Disclaimer: The Platform may feature an AI travel assistant. AI technology is prone to “hallucinations” (incorrect data). Users must independently verify AI advice regarding safety, transport, or health. The Company is not liable for outcomes resulting from AI suggestions.
9.1. Proprietary Assets: All resort guides, app structures, photography, trail maps, and logic are the exclusive intellectual property of Konstantinos Doukas. Scaping data or cloning the Platform structure for commercial gain is strictly prohibited.
9.2. External & Affiliate Links: The Platform features links to third-party sites (including, but not limited to, GetYourGuide, Welcome Pickups, and FerryHopper). Clicking these links redirects you to external platforms. The Company holds no liability for their performance, content, payment security, or service fulfilment.
10.1. User Liability: Users are solely responsible for the content they post (e.g., reviews). The Company is not liable for defamatory or infringing third-party content.
10.2. Moderation: We reserve the absolute right to remove any content or terminate any user account at our sole discretion, without notice, if we deem conduct to be harmful, fraudulent, or in breach of these Terms.
11.1. Financial Cap: To the fullest extent permitted by applicable law, the Company’s total aggregate liability to you for any and all claims arising from your use of the Platform is limited to fifty euros (€50.00).
11.2. Indemnification: You agree to indemnify the Company and Konstantinos Doukas against any legal claims, costs, or damages arising from your breach of these Terms.
12.1. Under Article 16(l) of EU Directive 2011/83/EU, the 14-day “cooling-off” period does not apply to date-specific travel, transport, or leisure services booked via Vendors on the Platform.
13.1. Greek Law: This Agreement is governed exclusively by the Laws of the Hellenic Republic.
13.2. Exclusive Venue: Any dispute shall be settled solely in the Competent Courts of Corfu, Greece. You waive any right to class action or pursuit in other jurisdictions.
