1.1. Scope: This Agreement governs the commercial relationship between Discover Corfu (the “Platform”) and the Vendor (the “Business,” “Provider,” or “Accommodation Owner”).
1.2. Service Definition: The Platform provides technical services including digital hosting and lead generation. The Vendor acknowledges that the Platform processes no customer payments for Vendor services and takes 0% commission on inquiries or bookings.
1.3. Digital Ecosystem: Services include hosting the Vendor’s profile on the Discover Corfu website and mobile application and providing the Direct Inquiry Engine (for Growth Package partners).
1.4. App Technology Disclaimer: The Vendor acknowledges that the “Near Me” feature on the Mobile App is currently based on area selection by the user and is not at present a real-time GPS tracking service.
2.1. Handpicked Selection: To safeguard the premium nature of the brand, the Platform operates on an invitation-only or vetted basis. The Vendor warrants they meet the following mandatory Inclusion Standards:
2.2. Right of Removal: Discover Corfu reserves the absolute right to remove any Vendor listing, without notice or refund, if the business fails to maintain these standards or receives verified reports of poor service.
3.1. Licensing: The Vendor warrants they possess all necessary GNTO/EOT (MITE) licences and insurance required by Greek law.
3.2. Tax Compliance: In accordance with Greek law and myDATA (AADE) mandates, the Vendor must provide a valid VAT Number (ΑΦΜ) for B2B invoicing.
3.3. Information Integrity: The Vendor is solely responsible for ensuring that all pricing, availability, and descriptions provided are accurate.
3.4. Climate Crisis Resilience Fee: In accordance with Greek Law (L. 5073/2023), a Climate Crisis Resilience Fee is applicable to all stays in collective and short-term accommodations. The Vendor (Accommodation Owner) acknowledges that they are solely and exclusively responsible for the calculation, collection from the guest, and remittance of this fee to the Greek Independent Authority for Public Revenue (AADE). The Platform accepts zero liability for the management or reporting of this statutory fee.
4.1. Subscription Tiers: Inclusion requires a non-refundable annual fee which is dependant on the package chosen.
4.2. Manual Renewals: Subscriptions are for 12 months from the point of going live and do not automatically renew. The Agency will contact the Vendor prior to expiry to discuss performance.
4.3. STRICT NON-REFUNDABLE POLICY: In accordance with B2B digital service standards, all fees are strictly non-refundable once payment is made. Service delivery is deemed commenced upon profile submission.
4.4. Single Entity Requirement: Each subscription fee covers one (1) specific business entity only. Separate properties (for example, different hotels or restaurants under the same owner) require separate subscriptions.
4.5. Prohibition of Cross-Promotion: Vendors are strictly prohibited from using a lead generated for a “Subscribed Business” to promote a “Non-Subscribed Business.”
5.1. No Guarantee of ROI: The Platform acts as a marketing facilitator. We make zero guarantees regarding views, clicks, leads, or financial return on investment (ROI).
5.2. “As Is” Availability: The Website and App are provided on an “As Is” basis. Discover Corfu utilizes third-party infrastructure and cannot guarantee 100% uninterrupted uptime.
5.3. Service Interruptions: Downtime may occur due to maintenance or third-party failures. The Vendor agrees that such interruptions do not entitle the Vendor to any refund, credit, or extension.
6.1. Hosting Shield: The Platform acts strictly as a digital facilitator. We accept zero liability for accidents, injuries, property damage, or fatalities occurring during a Vendor’s service or at their property.
6.2. Vendor Indemnity: The Vendor agrees to indemnify and hold harmless Discover Corfu and Konstantinos Doukas from any legal claims brought by third parties (Travellers).
6.3. Liability Cap: To the maximum extent permitted by law, the Agency’s total aggregate liability for any claim shall be limited to the total amount actually paid by the Vendor during the current 12-month term.
6.4. Consequential Loss: Under no circumstances shall the Agency be liable for indirect loss or loss of profits resulting from platform downtime.
7.1. Termination for Cause: The Platform may terminate this Agreement and delete a listing immediately, without refund, if the Vendor violates these terms, breaches the Single Entity Rule, or engages in fraudulent activity.
7.2. Reputational Protection: The Vendor agrees not to engage in any communication, public or private, designed to disparage the reputation of Discover Corfu, the Platform, or its Proprietor.
8.1. Exclusive Venue: This Agreement is governed by the Laws of the Hellenic Republic. All disputes shall be settled exclusively in the Competent Courts of Corfu, Greece.
8.2. Entire Agreement: This document constitutes the entire agreement between the parties. No other promises, verbal or written, shall be binding.
